Munger, Tolles & Olson’s Nate Sussman Authors Article on Generative AI and the Legal Profession
Munger, Tolles & Olson attorney Nate Sussman has authored an article titled “Two Open Questions as Generative AI Spreads Through the Legal Industry,” published in Bloomberg Law.
In his article, Mr. Sussman discusses two of the most significant questions attorneys and other legal professionals ask when determining whether to integrate generative artificial intelligence (AI) into their work — the “rules question” and the “functionality question.” The first question focuses on the rules that apply when using generative AI in legal practice, and the second focuses on how generative AI can be incorporated most effectively into workflows. The article reviews current guidance from state bars and federal courts, and describes certain benefits and costs associated with different approaches to rulemaking. It also discusses various use cases for generative AI and identifies several continuing limitations of the technology.
Mr. Sussman advises clients on a broad array of legal issues that arise in connection with generative AI, including with respect to intellectual property, regulatory frameworks and other matters. He serves as co-chair of Munger, Tolles & Olson’s Generative AI Task Force with Miriam Kim , and is a frequent public commenter on AI and the law. He is the author of “Generative Artificial Intelligence: Opportunities, Challenges, and Considerations for Attorneys” in Thomson Reuters’ 2024 edition of “eDiscovery for Corporate Counsel.”
