Munger, Tolles & Olson Secures Dismissal in Lawsuit Involving Stolen NFTs

Munger, Tolles & Olson successfully secured the dismissal of claims against NFT marketplace OpenSea in a federal lawsuit seeking $6 million in damages arising from stolen Bored Ape Yacht Club NFTs.

The U.S. District Court for the District of Nevada dismissed with prejudice a plaintiff’s claims against OpenSea, holding that the plaintiff’s claims were barred under the economic loss doctrine. The litigation stemmed from the theft of the plaintiff’s NFTs while trading.
